The following Terms of Service are applicable to Spring Street Networks and all Spring Street Networks partners and their online communities, including The Stranger. Note that this partners list is subject to change at any time; this Terms of Service is applicable to all current and future partners.)

The Stranger and its personals partner sites respect the intellectual property of others and we ask that our users do the same. If you believe that your copyrighted work has been infringed and you want us to take down or disable the infringement, please provide Spring Street Networks' copyright agent with the information requested in the Procedure for Notice of Complaint. The information requested is intended to substantially conform to the requirements set forth in the Digital Millennium Copyright Act, 17 U.S.C. Section 512 (c)(3)(A).

Title II of the Digital Millennium Copyright Act ("DMCA") of 1998, 17 U.S.C. Section 512 (c)(3)(A), limits the liability of online service providers for certain copyright infringement liability if various procedures are followed. This policy is intended to take advantage of the liability protections in the DMCA. Users who are found to repeatedly violate copyright rights of others may have their access to all services terminated.

The Designated Agent will accept reports alleging copyright infringement by persons using The Stranger's services.

Procedure for notice of complaint

The DMCA provides that certain information is required to submit a notice of complaint of copyright infringement. The Stranger and its partner sites require that the following information be submitted so that we may properly address any notice of complaint.

1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner or exclusive licensee.

2. Identification of the copyrighted work claimed to be infringed. If a notice refers to multiple works posted at a single location, it is sufficient to include a representative list of works infringed at the site

3. Identification of the material claimed to be infringing together with "information reasonably sufficient to permit the service provider to locate the material ." Specifically, a complete URL or URLs in the case of multiple works must be provided.

4. Information reasonably sufficient to permit us to contact the complaining party, including an address, telephone number, and email address

5. A statement that the complaining party believes, in good faith, that the copyrighted material identified is being used in a manner that is not authorized by "the copyright owner, its agent, or the law."

6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Any notification by a copyright owner or a person authorized to act on the copyright owners behalf that fails to comply with the provisions above shall not be considered sufficient notice and shall not be deemed to confer upon The Stranger or its partner sites actual knowledge of facts or circumstances from which infringing material or acts are evident.

Procedure for take down of alleged infringing material

When properly notified of the potential copyright infringement, the Designated Agent will make a reasonable effort to contact the site or page owner of the materials in question. There will be an attempt to secure the voluntary take down of the work, but, if not, then access to the work will be disabled unless it is determined that the work is lawful under the copyright law. The owner of the site or page of the alleged infringing material may exercise their counter notice procedure rights set forth below.

Procedure for counter notice

After voluntary take down or if the site is involuntarily disabled, the owner of the site may provide counter notification to the Designated Agent. Counter notices can claim only that either the copyright owner is mistaken and that the work is lawfully posted or that the work has been misidentified. A site owner may also assert that use of another's work is fair use, which falls under the provision that the copyright owner is mistaken in characterizing the work as infringing. Counter notices to the Designated Agent must contain the following:

1. A physical or digital signature of the site or page owner.

2. A description of the materials removed and its location before it was removed.

3. A statement that the owner believes in good faith that the material was removed by mistake or that the work is not infringing or that it was misidentified.

4. The owner's name, address and phone number and his or her consent to jurisdiction of the federal district court with proper jurisdiction for any court actions arising from the infringement.

5. A statement that the owner will accept service of process from the complaining party.

Access to the materials in question will be restored within 10 to 14 business days after the date the Designated Agent receives the counter notice unless the Designated Agent first receives a notice from the complaining party that he or she has filed an action seeking a court order to restrain the page owner.

The Designated Agent will promptly send a copy of any substantially conforming counter notice to the complaining party indicating that the site will be restored in the 10 to 14 business days unless the Designated Agent receives a notice of court action.
